SkillSignal Inc., a Delaware corporation (“SkillSignal,” “Company,” “We,” “Us,” or “Our”), respects Your privacy and is committed to protecting the personal information You share with Us when You use the SkillSignal mobile application, web interface, and related services (collectively, the “App”). This Privacy Policy (“Privacy Policy”) describes how We collect, use, disclose, store, and protect Your information in connection with the App.
This Privacy Policy is a legally binding agreement between You, the individual accessing or using the App (“You” or “Your”), and SkillSignal, and should be read in conjunction with our App Terms of Use at https://www.skillsignal.com/app-terms/.
By creating an account, accessing, or using the App, You acknowledge that You have read and understood this Privacy Policy and consent to the collection, use, and processing of Your information as described herein. If You do not agree with this Privacy Policy, do not create an account, access, or use the App.
This Privacy Policy applies only to information We collect through the App and in electronic communications sent through or in connection with the App. This Privacy Policy does not apply to information collected on the SkillSignal marketing website (www.skillsignal.com), which is governed by a separate Website Privacy Policy, or to information collected by any third party.
This Privacy Policy may be updated from time to time. If We make material changes, We will notify You through an in-App notification or by other reasonable means. Your continued use of the App after such changes constitutes acceptance of the updated Privacy Policy.
1. Your Relationship with SkillSignal and Your Subscribing Organization
Your access to the App is provided through a commercial subscription between SkillSignal and Your employer, contracting organization, project owner, or other entity (“Subscribing Organization”). SkillSignal processes Your personal information on behalf of Your Subscribing Organization to deliver the Services. Your Subscribing Organization determines the purposes for which Your data is collected and processed through the App, and SkillSignal acts as a service provider processing data at the direction of the Subscribing Organization.
Information You provide through the App, including registration data, professional certifications, completed safety forms, time and attendance records, location data, photographs, and other content, may be accessed by and shared with Your Subscribing Organization and its authorized personnel as part of the Services. If You have questions about how Your Subscribing Organization uses Your data, You should contact Your Subscribing Organization directly.
2. Information We Collect
We collect information from and about users of the App in the following ways:
2.1. Information You Provide Directly
When You register for and use the App, We collect information You voluntarily provide, including:
- Identity Information: First and last name, date of birth, photograph (including selfies used for identity verification).
- Contact Information: Telephone number, email address, mailing address.
- Employment Information: Employer name, job title or role, trade or skill category, union or labor organization affiliations.
- Professional Credentials: Professional certifications, licenses, training records, certification expiration dates, and documentation thereof (including photographs of certificates and cards).
- Safety and Compliance Data: Completed safety forms (including Job Hazard Analyses, Pre-Task Plans, and similar documents), safety orientation records, toolbox talk acknowledgments, site observation reports, incident reports, and inspection records.
- User Content: Any other information, documents, photographs, or materials You upload or submit through the App.
2.2. Information Collected Automatically
When You access and use the App, We may automatically collect:
- Device Information: Device type, unique device identifier, operating system and version, browser type, mobile network information, IP address, and device telephone number.
- Usage Information: Details of Your access to and use of the App, including login dates and times, features used, pages viewed, actions taken, traffic data, and other communication data.
- Location Data: With Your permission, precise geolocation data from Your mobile device’s GPS to support time and attendance tracking, site access verification, and workforce management. Location data is collected only when You are actively using the App and have granted location permissions on Your device. You may disable location services through Your device settings at any time, but doing so may limit certain App functionality.
- Stored Information: With Your permission, metadata and other information associated with files stored on Your device that You choose to upload to the App.
2.3. Biometric Information
The App may include features that collect biometric identifiers or biometric information (“Biometric Data”), including:
- Facial Geometry: Facial scans or facial recognition data used for identity verification and access control.
- Other Biometric Identifiers: Fingerprint data or other physiological characteristics, if and when such features are made available.
Biometric Data is collected only when biometric features of the App are activated and only with Your express consent or the consent of the individual whose Biometric Data is being collected. For more information about how We handle Biometric Data, see Section 9 (Biometric Data) below.
2.4. Information from Third Parties
We may receive information about You from Your Subscribing Organization, including employment status, project assignments, and other information necessary to configure Your account and provide the Services. We may also receive information from third-party integration partners when the App is connected to third-party systems at the direction of Your Subscribing Organization.
3. How We Use Your Information
We use the information We collect for the following purposes:
- Providing the Services: To operate, maintain, and deliver the App and its features, including workforce management, safety and compliance tracking, certification management, time and attendance, access control, and communications.
- Account Administration: To create and manage Your account, authenticate Your identity, and process Your requests.
- Subscribing Organization Obligations: To fulfill Our obligations under the Enterprise Agreement with Your Subscribing Organization, including providing reports, dashboards, analytics, and other data outputs.
- Communications: To send You service-related communications, including account notifications, update alerts, security alerts, and support messages.
- Improvement and Development: To analyze usage patterns, diagnose technical issues, and improve the App’s features, functionality, performance, and user experience.
- Safety and Security: To detect, prevent, and address fraud, unauthorized access, security incidents, and technical issues.
- Legal Compliance: To comply with applicable laws, regulations, legal processes, and governmental requests, and to enforce Our Terms of Use and protect Our rights and the rights of others.
4. How We Share Your Information
We do not sell Your personal information. We may share Your information in the following circumstances:
- With Your Subscribing Organization: We share Your information with Your Subscribing Organization and its authorized personnel as necessary to provide the Services. This includes registration data, certifications, completed forms, time and attendance records, location data, safety observations, incident reports, and other data generated through Your use of the App.
- With Service Providers: We share information with third-party service providers who perform services on Our behalf, such as cloud hosting, data storage, analytics, customer support, and communications. These providers are contractually obligated to use Your information only for the purposes for which We disclose it to them and to maintain its confidentiality.
- With Insurance Carriers and Brokers: We may share aggregated, anonymized, or de-identified project-level data with insurance carriers, brokers, or risk management partners in connection with insurance program administration, loss prevention analysis, risk assessment, or similar purposes. Such shared data will not identify individual workers unless required by law or authorized by the applicable Subscribing Organization.
- With Affiliates and Subsidiaries: We may share information with Our affiliates and subsidiaries for internal administrative and business purposes.
- In Connection with Business Transfers: In the event of a merger, acquisition, corporate restructuring, sale of assets, bankruptcy, or similar transaction, Your information may be transferred to the acquiring entity or successor. We will provide notice of any such transfer through the App or other reasonable means.
- For Legal Purposes: We may disclose Your information if required to do so by law, or in the good-faith belief that disclosure is necessary to: (a) comply with applicable law, regulation, court order, or legal process; (b) enforce Our Terms of Use or other agreements; (c) protect the rights, property, or safety of SkillSignal, Our users, or others; or (d) detect, prevent, or address fraud, security, or technical issues.
- With Your Consent: We may share Your information for any other purpose with Your consent.
Subprocessors. SkillSignal engages third-party subprocessors to assist in providing the Services. A current list of subprocessors is available upon request by contacting info@skillsignal.com or may be published at https://www.skillsignal.com/subprocessors/. Subscribing Organizations that have executed a Data Processing Agreement (DPA) with SkillSignal will be notified of material changes to the subprocessor list in accordance with the terms of the DPA. A DPA is available to Subscribing Organizations upon request.
5. Cookies and Tracking Technologies
We may use cookies and similar tracking technologies (such as web beacons, pixels, and local storage) to collect information about Your use of the App and to enhance Your experience.
Our use of cookies, advertising, and tracking technologies may constitute a “sale” or “sharing” of personal information under certain U.S. state consumer privacy laws. For information about Your rights regarding such tracking, see Section 10 (Your Privacy Rights) below.
You can manage cookie preferences through Your device or browser settings. Disabling cookies may affect certain functionality of the App.
6. Data Storage and Security
6.1. Data Storage. Your information is stored on servers located in the United States, hosted by Amazon Web Services (AWS). All data processing occurs within the United States.
6.2. Security Measures. We implement commercially reasonable technical, administrative, and physical security measures designed to protect Your information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit and at rest, access controls, and regular security assessments.
6.3. Your Responsibilities. The security of Your information also depends on You. You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account. You should not share Your password with anyone.
6.4. No Guarantee. Despite Our efforts, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of Your information. Any transmission of information is at Your own risk.
7. Data Retention
We retain Your information for as long as Your account is active, as necessary to provide the Services to Your Subscribing Organization, or as required to fulfill the purposes described in this Privacy Policy. We may also retain certain information as necessary to comply with legal obligations, resolve disputes, enforce Our agreements, and as permitted by applicable law.
When Your information is no longer needed for any of these purposes, We will delete or de-identify it in accordance with Our data retention practices and applicable law. Aggregated or de-identified data that cannot reasonably be used to identify You may be retained indefinitely.
8. Data Breach Notification
In the event of a data breach involving Your personal information that poses a risk of harm, We will notify affected individuals and applicable regulatory authorities as required by applicable federal, state, and local laws. Notification will be provided through the App, by email, or by other reasonable means, within the timeframes required by law.
9. Biometric Data
9.1. Collection and Purpose. Where biometric features of the App are activated, We may collect Biometric Data, including facial scans and other biometric identifiers, for purposes of identity verification, access control, time and attendance tracking, and fraud prevention.
9.2. Consent. We collect Biometric Data only with the express consent of the individual whose data is being collected or the consent of the individual’s authorized representative. Consent may be obtained through the App’s registration process, through a separate consent form, or through Your Subscribing Organization’s enrollment procedures.
9.3. Third-Party Processing. Biometric Data may be processed by Our authorized service providers solely on Our behalf and for the purposes described above. We do not sell, lease, trade, or otherwise profit from Biometric Data. We do not share Biometric Data with any third party except: (a) with Your consent or the consent of Your authorized representative; (b) as required by a valid warrant, subpoena, or court order; or (c) as otherwise required by law.
9.4. Retention and Destruction. We retain Biometric Data only for as long as necessary to fulfill the purposes for which it was collected, and in no event longer than three (3) years after Your last interaction with the App, unless a longer retention period is required by law. When Biometric Data is no longer needed, We will permanently destroy it using commercially reasonable methods.
9.5. Your Rights. You have the right to limit the use and disclosure of Your Biometric Data if We are using it beyond what is reasonable and proportionate to provide the requested Services. To exercise this right or to request deletion of Your Biometric Data, contact Us at info@skillsignal.com.
9.6. Compliance. We comply with all applicable federal, state, and local laws governing the collection, use, storage, and destruction of Biometric Data, including the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), the Washington State biometric privacy law, and any other applicable biometric privacy statutes.
10. Your Privacy Rights
Depending on Your state of residence, You may have certain rights regarding Your personal information under applicable privacy laws. SkillSignal respects these rights for all users regardless of state of residence, to the extent practicable.

- Access: You may request information about the categories and specific pieces of personal information We have collected about You.
- Correction: You may request correction of inaccurate personal information. You can also review and update certain information directly through Your account settings in the App.
- Deletion: You may request deletion of Your personal information, subject to certain exceptions permitted by law.
- Portability: You may request a copy of Your personal information in a structured, commonly used, machine-readable format.

- Non-Discrimination: We will not discriminate against You for exercising any of Your privacy rights.
10.2. Additional California Disclosures (CCPA/CPRA)
If You are a California resident, You have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), including the right to know what personal information We collect and how it is used, the right to request deletion, the right to correct inaccurate information, the right to opt out of the sale or sharing of personal information, and the right to limit the use of sensitive personal information.
Shine the Light: California Civil Code Section 1798.83 permits California residents to request information about Our disclosure of personal information to third parties for direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
Verification: To protect Your privacy, We may require You to verify Your identity before processing Your request. We will respond to verified requests within forty-five (45) days, or as otherwise required by the CCPA/CPRA.

11. Children’s Privacy
The App is not directed to persons under the age of 18 and must not be used by any person under 18. We do not knowingly collect or solicit information from children under 18. If We become aware that We have collected personal information from a child under 18, We will take steps to delete such information and terminate the associated account. 12. Third-Party Services
The App may contain links to or integrations with third-party services. This Privacy Policy does not apply to any third-party services, and We are not responsible for the privacy practices of any third party. We encourage You to review the privacy policies of any third-party services before providing them with Your information.
13. Controlling Language
This Privacy Policy is provided in the English language. To the extent any translated version conflicts with the English version, the English version shall control.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in Our practices, technology, legal requirements, or other factors. If We make material changes, We will notify You through an in-App notification, by email, or by other reasonable means prior to the changes becoming effective. The “Last Updated” date at the top of this Privacy Policy indicates when it was last revised. Your continued use of the App after the effective date of any changes constitutes acceptance of the updated Privacy Policy.
