SkillSignal Mobile Application Privacy Policy

Introduction 
SkillSignal LLC, a Delaware limited liability company ("SkillSignal" or "we"), respects your privacy and is committed to protecting it through our compliance with this policy.  This privacy policy sets out the basis on which we will process any personal data we collect from you, or which you provide to us when you register and use SkillSignal (including all related documentation, the “Application”), or any services provided through it.

 

This policy describes: (a) the types of information we may collect or that you may provide when you register or use the Application and (b) our practices for collecting, using, maintaining, protecting, and disclosing that information.  This policy applies only to information we collect in the Application and in any email, text, and other electronic communications sent through or in connection with the Application.

 

This policy DOES NOT apply to information that: (a) we collect offline or on any other SkillSignal applications or websites, including websites you may access through the Application or (b) you provide to or is collected by any third party.  Our websites and applications, and these third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
 
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. By installing, using or otherwise accessing the Application from any device, mobile or otherwise, you are agreeing to abide by the terms and conditions of this privacy policy.  If you do not agree with our policies and practices, do not download, register or use the Application. By downloading, registering or using the Application, you agree to this privacy policy. If you do not agree to abide by the terms and conditions of this privacy policy, do not download and/or access the Application. This policy may change from time to time. Your continued use of the Application after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

 

Information We Collect From You  

We collect information from and about users of the Application (a) directly from you when you provide it to us and (b) automatically when you use the Application.  
When you register to use the Application, we ask you to provide certain personal information, including such things as:

  • First and last name of user 

  • Telephone number 

  • Employer 

  • Professional certifications

  • Professional skills 

  • Organizations you may be associated with (e.g., Unions and Real Estate Developers)

  • IP address

  • Certain dates and times of transactions with the application (such as when you login, when you update certifications, etc.)

  • Photos (such as so-called selfies and photos of professional documentation)

 

Automatic Information Collection
When you use the Application, it may use technology to automatically collect:

  • Usage Details. When you access and use the Application, we may automatically collect certain details of your access to and use of the Application, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Application.

  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.

  • Stored Information and Files. The Application also may access metadata and other information associated with other files stored on your device. This may include, for example, personal contacts, and address book information.

  • Location Information. This Application collects real-time information about the location of your device. Location data is only captured when you are using the application by calling on the GPS coordinates of the device. This location and time information might be transmitted to your employer to create timesheets or individual time tracking during working hours. You may opt out of the Application’s collection of location information at any time by changing the location tracking settings on your device.  Note, however, that opting out of the Application’s collection of location information will cause its location-based features to be disabled.

 

Information Collection and Tracking Technologies
The technologies we use for automatic information collection may include GPS technology, cookies and others.  A cookie is a small file placed on your mobile device.  It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device.  However, if you select this setting, you may not be able to access certain parts of the Application. 

 

How We Use Your Information     
We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the Application and its contents, and any other information, products or services that you request from us.

  • Fulfill any other purpose for which you provide it

  • Give you notices about your account, including expiration and renewal notices.

  • Notify you when Application updates are available, and of changes to any products or services we offer or provide though it.

 

The usage information we collect such as date and time of usage, preferences, and more helps us to improve the Application and to deliver a better and more personalized experience by enabling us to:

  • Store information about your preferences, allowing us to customize the Application according to your individual interests.

  • Speed up your searches.

  • Recognize you when you use the Application.

 

Location data is only captured when you are using the application by calling on the GPS coordinates of the device. This location and time information might be transmitted to your employer to create timesheets or individual time tracking during working hours.
 

We will retain information that we collect about you and usage information for so long as you use the Application and for up to twelve (12) months thereafter, unless we are required to retain it for a longer period of time to fulfill a legal requirement.  

 

Disclosure of Your Information  

We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.
 In addition, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates.

  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce our rights arising from any contracts entered into between you and us, including the SkillSignal Mobile Application End User License Agreement.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of SkillSignal LLC, our customers or others. 

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of SkillSignal LLC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by SkillSignal LLC about our Application users is among the assets transferred.

 

Accessing and Correcting Your Personal Information  

You can review and change your personal information by logging into the Application and visiting your account profile page.

 

Data Security
The account of every user is protected by a user-created password. While we cannot guarantee the security of user account information, we take reasonable precautions to protect the information of our users, as well as information collected from other users. We use industry standard or better measures to protect all information that is stored on our servers and within our database. We limit the access to this information to those employees who need access to perform their job function such as our customer service personnel and technical staff. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.  
 

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our Application. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
 

Changes to Our Privacy Policy  

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will notify you by an in-Application alert the first time you use the Application after we make the change or by text message to the phone number specified in your account.
 
The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable phone number for you and for periodically viewing this privacy policy to check for any changes.

 


CHILDREN’S PRIVACY.

The Application is not directed to persons under the age of 18 and should not be downloaded by any person under the age of 18. If you become aware that your child has provided us with personal information without your consent, please contact us at info@skillsignal.com. We do not knowingly collect or solicit information from, market to or accept services from children. If we become aware that a child under 18 has provided us with personal information, we will take steps to remove such information and terminate the child’s account.  

 


CALIFORNIA RESIDENTS.  

Under the California Consumer Privacy Act (“CCPA”), California residents have certain rights regarding their personal information. If you would like to exercise these rights, please contact us using the email address, toll-free phone number, or physical mailing address, or other mechanism listed within the “Contact Information” section below.  For your own privacy and security we may require you to prove your identity before providing the requested information, as provided for by the CCPA. We will respond within the requirements of the CCPA.

If you are a job applicant, you may provide certain personal information to us, including email address, phone number, name, SSN and government issued identification numbers.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.
